Four BBC presenters launch Equal Pay Appeal

Four female BBC presenters have appealed against a decision of a tribunal that denied them the right to pursue an equal-pay claim.

In 2020, Martine Croxall and Kasia Madera entered into settlement agreements, but they continued to claim that they were paid less than their male counterparts performing the same roles.

They claimed that the Corporation did not address ongoing inequality, but only historical disparities in pay.

A preliminary Hearing in May 2024 ruled that presenters were not allowed to include equal pay in their complaint against the broadcaster.

The judge ruled that the settlements made previously meant the women were not able to bring new claims for pay individually. However, they could do so as a collective.

Thompsons Solicitors will represent the presenters in their appeal against this decision, with the National Union of Journalists as a supporter.

Neil Todd, partner at Thompsons Solicitors said: “The Appeal raises important questions as to how out-of court settlements can cover unlawful future actions. The agreements in question are, according to us, unenforceable under the law.

Michelle Stanistreet said that the NUJ was “deeply worried” about the court’s decision to block the claims.

She added, “We don’t accept that the continued practice of pay discrimination in this manner can be excused. We look forward to presenting this case at the Employment Appeal Tribunal.”

Presenters continue to be involved in broader claims against the BBC. They allege discrimination based on age and gender. These cases are scheduled to be heard by 2025.
